The rules that apply when you download, browse, and use eSIMply.
These Terms & Conditions (“Terms”) govern your use of the eSIMply mobile application and website (together, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use eSIMply.
1. Who we are
eSIMply provides a platform to browse travel eSIM packages, fund an in-app wallet via Apple or Google in-app purchases, and obtain eSIM profiles for compatible devices. Support is available atesimplysupport@gmail.com.
2. Eligibility
- You must be legally able to enter a binding agreement.
- You must use a device that supports eSIM and meet any store or carrier requirements for installation and use.
- You are responsible for complying with local laws regarding telecom and data services in places you travel.
3. The service
Package availability, coverage, speeds, fair-use policies, and network partners may vary by destination and can change. Validity typically starts when the eSIM first connects to a supported network, unless a package description states otherwise.
eSIMply is not a mobile network operator. Connectivity is provided through third-party partners. We do not guarantee uninterrupted coverage, particular speeds, or availability in every location.
4. Accounts and your responsibilities
- Provide accurate information when using the Service.
- Keep your device and any credentials secure.
- Do not misuse the Service, attempt unauthorized access, interfere with other users, or use eSIMs for unlawful activity.
- Follow install instructions carefully. Incorrect installation or device incompatibility may prevent activation.
5. Wallet, purchases, and pricing
Wallet top-ups are processed by Apple App Store or Google Play using their in-app purchase systems. Prices shown in the app may include applicable store fees as described in-product. Currency display depends on the store and your account region.
- Purchases are subject to the terms of Apple or Google in addition to these Terms.
- Wallet balance may be used to redeem eligible eSIM packages available in the app.
- We may refuse or cancel transactions that appear fraudulent, erroneous, or abusive.
6. Refunds
Because digital eSIM services may be provisioned promptly, refunds are limited. For purchases made through an app store, refund requests are primarily handled under that store’s policies and tools.
If an eSIM cannot be delivered due to a clear service fault on our side, contactesimplysupport@gmail.com with your order details and we will review available remedies. Unused wallet balance may be non-transferable and may expire if required by law or stated in the app.
7. Intellectual property
The eSIMply name, logo, app design, and content are owned by us or our licensors. You may not copy, modify, distribute, or reverse engineer the Service except as allowed by law.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, eSIMply AND ITS PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID TO US FOR THE SPECIFIC PACKAGE OR WALLET TOP-UP GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT, OR USD $50 IF GREATER LIABILITY CANNOT BE EXCLUDED.
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.
10. Suspension and termination
We may suspend or terminate access if you violate these Terms, create risk for the Service or other users, or if required by partners or law. You may stop using the Service at any time.
11. Changes
We may update these Terms or the Service features from time to time. We will post updated Terms on this page with a new “Last updated” date. Continued use after changes constitutes acceptance.
